By accessing and using the services provided by Workin Software ("Company", "we", "us", or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Workin Software provides professional software development services including:

  • Mobile Application Development
  • Business Administration Systems
  • Content Management Systems (CMS)
  • Learning Management Systems (LMS)
  • Customer Relationship Management (CRM)
  • Enterprise Resource Planning (ERP) Development
  • Consulting and Technical Support

3. Client Obligations

As our client, you agree to:

  • Provide accurate and complete information necessary for project completion
  • Respond to requests for feedback and approvals in a timely manner
  • Make payments according to the agreed schedule
  • Provide necessary access to systems, accounts, and resources as required
  • Respect intellectual property rights
  • Use our services in compliance with applicable laws and regulations

4. Payment Terms

Payment terms will be specified in individual project agreements. Generally:

  • Payment schedules are based on project milestones or monthly retainers
  • Invoices are due within 30 days of issuance unless otherwise specified
  • Late payments may incur additional fees
  • Work may be suspended for overdue payments
  • All fees are exclusive of applicable taxes

5. Intellectual Property

Client-Owned Work Product

Upon full payment, clients will own the custom software, applications, and content specifically developed for their project, subject to any third-party licenses.

Company-Owned Assets

We retain ownership of our proprietary methodologies, frameworks, tools, and general knowledge. We reserve the right to use general knowledge and experience gained from projects in future work.

6. Confidentiality

We respect the confidentiality of all client information and agree not to disclose confidential information to third parties without consent, except as required by law. We may require separate confidentiality agreements for sensitive projects.

7. Project Timelines

Project timelines are estimates based on the information available at the start of the project. Delays may occur due to factors including client feedback cycles, scope changes, technical challenges, or external dependencies. We will communicate any potential delays promptly.

8. Scope Changes

Changes to project scope, requirements, or deliverables may affect timeline and cost. All significant scope changes will be documented in writing and agreed upon before implementation. Additional work outside the original scope will be billed separately.

9. Warranties and Disclaimers

Limited Warranty

We warrant that our services will be performed with professional skill and care. We will correct any defects in our work at no additional charge for a period specified in the project agreement.

Disclaimers

Except as expressly stated, our services are provided "as is" without warranties of any kind. We do not guarantee specific business results or performance metrics.

10. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We shall not be liable for indirect, incidental, special, or consequential damages.

11. Termination

Either party may terminate a project agreement with written notice. Upon termination, the client will pay for all work completed up to the termination date. We will provide all deliverables completed and paid for as of the termination date.

12. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Adana, Turkey, according to Turkish law.

13. Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or other force majeure events.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of Turkey. Any legal proceedings shall be subject to the jurisdiction of the courts in Adana, Turkey.

15. Changes to Terms

We may update these terms from time to time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the updated terms.
